An Overview of the South Korea AI Basic Act

In short, South Korea implemented their AI Basic Act which goes into effect in January 2026 and is designed to ensure the safe and responsible development and use of AI. Ultimately, South Korea aims to strike a balance between fostering AI advancements and maintaining robust regulatory oversight. Beyond applying to South Korea-based businesses, this act extends to any entity conducting business within the South Korean market and mandates that companies outside of South Korea appoint a domestic representative. 

Also worth noting, the South Korea Basic AI Act classifies certain AI applications as high-impact if they have the potential to significantly impact human lives, rights, or safety, such as those in energy, healthcare, and other government industries.  

The act enforcement date stands as January 22, 2026, giving organizations roughly a year from the passage of the law to align their AI operations with the new requirements. Companies that plan to continue working in South Korea’s AI market should start preparing now to ensure smooth compliance.  

With AI regulations becoming more prevalent, South Korea’s Basic AI Act sets an important precedent for balancing innovation and responsibility.
